General Terms and Conditions of Sale

Preamble

These general terms and conditions of sale (hereinafter referred to as "general terms and conditions of sale") govern the contractual relationship between, on the one hand, natural or legal persons wishing to make a purchase in the stores or on the website of Lecomte Alpinisme & Randonnée, hereinafter referred to as "the Buyer" and, on the other hand, the company Lecomte Alpinisme & Randonnée SA (whose registered office is located at Rue de Vergnies 27-29 - Tel.: +32 (0)2 201 92 97 - E-Mail: [email protected] - VAT BE 0426.637.276), hereinafter referred to as "Lecomte".

The publication manager is Mr. Christophe Lecomte, Managing Director of Lecomte Alpinisme & Randonnée.

1. Purpose and scope of application

These general terms and conditions of sale set out the terms and conditions of sale between Lecomte and the Buyer. They apply to all sales of products offered both in physical stores / climbing stores / pop-up stores during events (hereinafter referred to as the "Stores") or on the Lecomte Alpinisme & Randonnée online sales website (hereinafter referred to as the "Webshop"), whether the order was placed in person, by telephone, by fax, by postal mail, by email, by direct messaging (chat) or via the Internet.

Any sale or order in the Stores and on the Webshop implies that the Buyer has read these general terms and conditions of sale prior to the sale, and acceptance of their entire content by the Buyer. Acceptance of these general terms and conditions of sale takes effect upon validation of the order by the Buyer. These general terms and conditions of sale are available in Stores, sent by email to each new customer who gives their agreement (including in the event of modification) at each transaction; a link is also present at the bottom of each receipt, electronic receipt and invoice referring to the general terms and conditions.

The applicable general terms and conditions of sale are those in force on the date of validation of the order by the Buyer. Lecomte reserves the right to modify, at any time and without notice, the general terms and conditions of sale, the modifications then being applicable to all orders subsequent to such modification.

These general terms and conditions of sale take precedence over all general terms and conditions of purchase submitted by the Buyer and may under no circumstances be cancelled or revoked by the latter, except by explicit agreement between both parties regarding the clauses subject to exception.

Any modification of the general terms and conditions of sale will be subject to a new agreement at each new purchase by the Buyer.

2. The Lecomte Alpinisme & Randonnée offer

2.1 Geographic coverage of the offer

Products are offered for sale by Lecomte in its Stores (located in Belgium) and on the Webshop. The latter delivers to most countries. The geographic coverage area of each sale may vary depending on the distribution agreements with each referenced supplier, as well as the delivery methods. Lecomte may use filters on the Website to block orders from countries not covered by the offer. At the European level, destinations requiring customs formalities are excluded, such as the territory of Büsingen, the island of Heligoland, Jersey, Guernsey, the Isle of Man, the territories of Campione d'Italia and Livigno, the Canary Islands, Ceuta, Melilla, the Faroe Islands, Greenland, Åland, Mount Athos and the northern part of Cyprus.

2.2 Stock and availability

Products offered in Stores are available for immediate sale.
Products offered on the Webshop are accompanied by an exact availability date and an approximate delivery time. This information is updated regularly. A product listed as "in stock" is present in Lecomte's own inventory. The actual availability of a product may change rapidly depending on sales made on the Webshop or the stock of products held by our suppliers (some products are supplied on a just-in-time basis).

Lecomte cannot be held responsible if the indicative availability period of the product(s) and their delivery is modified as a result. In the event of a product being unavailable after an order has been placed, Lecomte undertakes to contact the Buyer as soon as possible, by phone or email. The Buyer may choose to maintain their order without the missing product (in the case of an order containing several products) or to cancel it. Lecomte will process the refund by crediting the bank account or payment method used no later than fourteen (14) days after the Buyer's payment.

When an item is unavailable in our Stores and on the Webshop, the Buyer has the option of being notified of its availability by clicking on the "Notify me when back in stock" button. The buyer is then asked to select the model and leave their email address to receive a notification when the item is back in stock.

2.3 Orders, reservations and hold requests

For all products not in stock in the Stores or on the Webshop, the Buyer has the option of placing a reservation order, either directly in the Stores, or by phone, email or direct messaging (chat). The availability of this order may vary depending on the brand, the supplier or the availability of the item in another Lecomte Store. The customer will be informed of the approximate lead times when placing their order. If the ordered item is not part of the range regularly stocked by the Stores, Lecomte reserves the right to request a 50% deposit to validate the order or may simply refuse the order. The Buyer must provide, at a minimum, their phone number and email address in order to place a reservation order. In the case of an order placed remotely (by phone, email or direct messaging), a payment link will be sent to the buyer by email, if the order requires a deposit. A reservation order can be sent directly to the Buyer's home address upon payment of shipping costs, regardless of the transaction amount.

If the lead times for reservation orders are deemed too long and provided that the order placed with Lecomte's supplier can still be cancelled, Lecomte may refund the deposit received to the Buyer upon simple request. If the order with the supplier can no longer be cancelled, Lecomte reserves the right to retain 50% of the deposit value with a minimum of ten (10) euros, in order to cover the administrative costs incurred.

Upon receipt of a reservation order, the Buyer is notified primarily by SMS or email. The Buyer has a period of seven (7) days to collect their order from the Store. After this period, the item will be returned to the shelves and the reservation order cancelled. In the event that a deposit has been paid, Lecomte reserves the right to retain 50% of the deposit value with a minimum of ten (10) euros, in order to cover the administrative costs incurred. The same conditions apply in the event of the Buyer refusing to purchase the ordered item, or in the case of an exchange or refund of that item. The price applied for a reservation order will be the price in effect on the day of purchase.

Lecomte also accepts limited hold requests on its in-stock items. This service is only available in Stores and the maximum duration of a hold request is twenty-four (24) hours. A deposit may also be requested for a hold, under the same conditions as reservation orders. The price applied for a hold request will be the price in effect on the day of the hold.

2.4. Product specifications

The products offered for sale are described and presented as accurately as possible. However, if any errors or omissions have occurred in this presentation, whether in Stores or on the Webshop, Lecomte cannot be held liable. The photographs visible on the Webshop are not contractually binding.

2.5. Pricing policy

The prices of our products are shown in euros, inclusive of all Belgian taxes, and are firm and final, both in Stores and on the Webshop. They do not include shipping costs and other handling fees related to the Buyer's order, which are charged additionally and indicated before the Buyer validates their order. Lecomte reserves the right to modify its prices at any time without notice. Products will be invoiced to the Buyer based on the prices recorded at the time of order validation. We regularly carry out maintenance operations on our Webshop. These may generate pricing errors. In such cases, the order cannot be fulfilled and we will contact you to cancel your order as soon as possible. Products remain the property of Lecomte until full payment has been received.

2.5.1. Lecomte Labels

Products stamped with the "Lecomte Label" are guaranteed to offer the best value for money in Belgium. They are generally associated with a price significantly lower than the recommended retail price. The Lecomte Label conditions only apply to products correctly identified as such.

Current promotions do not apply to Lecomte Labels unless otherwise stated in Stores or on the Webshop. The Lecomte loyalty programme applies to Lecomte Labels.

The Labels guarantee the lowest (or equal) price in Belgium (excluding promotions). If the Buyer finds one of the Lecomte Labels cheaper at another retailer, they simply need to provide proof of the price difference. This can take various forms: a photo, a screenshot, etc. The Buyer must send this proof to [email protected] with the necessary details (including their proof of purchase if the product has already been bought). Lecomte will verify that the price difference meets the conditions for applying the Lecomte Label. If the Buyer has already purchased the product, Lecomte will refund the difference in the form of vouchers valid for 1 year in all our Stores or on our Webshop. Lecomte will automatically update the new price across all its sales platforms.

The lowest price guarantee only applies to retailers located in Belgium and sales on websites with a registered place of business in Belgium.

Time-limited promotions and any other temporary price reductions will not be taken into account in the lowest price guarantee. Any sign that could suggest a promotion (crossed-out price, time limit, etc.) will be taken into account when evaluating the Buyer's refund request.

Irrefutable proof must be included with the price difference refund request (photos, screenshots, etc.). Lecomte reserves the right to validate the proof.

The Buyer has thirty (30) days after the date of purchase to notify Lecomte of the price difference. After this period, no refund request will be accepted.

2.5.2. Sales and promotions

Promotions are clearly indicated in Stores and on the Webshop by means of specific signage. This is generally accompanied by a discount percentage and the new price applied. During general promotions, it is possible, in Stores, that product labels may not be updated; the discount will, in any case, be automatically applied at the checkout.

Promotions are mostly limited in time. They may also be related to the end of a collection or the end of seasonal products. Promotions are exchangeable or refundable, according to the terms explained further on (unless otherwise stated).

When a temporary promotion starts, we offer our customers the opportunity to take advantage of it even if their purchases were made within the three (3) working days prior to the start of the temporary promotion. The refund of the difference will be issued as a credit added to the customer's account, which they can use for a future purchase. Simply send an email to [email protected] to exercise this right.

For BOGO (Buy One Get One - e.g.: 50% discount on the second product purchased) type promotions, any refund must cover all products included in the promotion, or the benefit received during this promotion will be deducted from the refunded product at the time of the refund request.

Sales take place in January and July. The return policy for sale items or end-of-life products is the same as for a regular promotion: 30 days right of return.

2.5.3. Special rates and conditions

The Buyer may exceptionally benefit from special rates or conditions at Lecomte Stores. These benefits are, for the most part, governed by specific agreements and conventions, and are only valid under very specific ordering conditions.

These benefits cannot be combined with other promotions or offers proposed by Lecomte and are strictly personal.

2.6. Export orders and customs duties

Any order shipped outside the European Union will be invoiced excluding tax at the Buyer's request. The Buyer can make this request shortly after their purchase by email or via direct messaging. The amount of tax collected will be immediately refunded and their invoice adjusted accordingly. Import formalities, customs duties and any applicable taxes related to the delivery of an item outside the European Union are the sole responsibility of the Buyer. They must be paid to the competent authorities of the country of delivery. The Buyer is solely responsible for verifying the import possibilities of the ordered products in accordance with the law of the country of delivery. Lecomte is not required to verify or inform the Buyer of applicable customs duties and taxes. To find out more, Lecomte advises the Buyer to enquire with the competent authorities of their country. By ordering on the Webshop, the Buyer is considered the official importer and is required to comply with all laws and regulations of the country where they will receive the goods. Cross-border deliveries may be subject to an opening and inspection procedure by customs authorities.

2.7. Embassies and VAT on exports

Regarding exports outside the EU by a private individual with a fixed address outside the EU (tourists)
Tax refunds are managed by the company Global Blue.
If the Buyer makes a purchase in our Stores with the intention of exporting it outside the European Union, they must request a tax refund form and a prepaid Global Blue envelope at the checkout. This form must be stamped by customs upon your departure from the European Union. You can receive your VAT refund at one of the many Global Blue refund points located in European airports, or by sending your Tax Free form along with the receipt or invoice to Global Blue in the envelope provided.

Conditions:

  • Minimum purchase amount: €125.01 incl. VAT.
  • Reserved for persons aged 18 and over.
  • The date of departure from the EU must occur no more than 3 months after the ticket is issued.
  • The refund will not cover the full VAT amount (21%), as a margin is charged by Global Blue, the rate of which varies depending on the country.

Customer responsibility:
Sending the form to Global Blue is entirely the customer's responsibility. No tax refund will be made directly by our store. Regarding purchases by diplomats in our Stores
They also benefit from the right to reclaim VAT paid in two ways:

  • either directly at the checkout, at the time of purchase by presenting their Diplomatic Card and following the procedure described on the website https://diplomaticcard.be/
  • or through the organisations designated for this purpose.

2.8. Equipment rental service

The Renter is fully aware that a number of risks are inherent to outdoor sports, risks that can never be attributed to the equipment or Lecomte. By signing the rental form, the Renter declares having provided correct data regarding the rental, which has enabled Lecomte to make the correct adjustments. The Renter acknowledges having checked the settings upon receipt of the equipment. They have read and understood these general terms and conditions.

2.8.1. Rental period

The rental begins at the moment the Renter or their representative receives the rented equipment from the lessor at our Stores. The Renter who fails to collect or receive the rented equipment at the agreed time remains, nonetheless, bound by the rental agreement for the agreed duration or for a period at least equal to that indicated as the presumed rental period. All this without prejudice to any possible compensation. Lecomte's promises in relation to the delivery date are not binding and do not constitute grounds for termination of the agreement or for compensation.

The rental ends, if it has been expressly agreed for a fixed period, on the agreed date, without Lecomte being able to invoke tacit renewal.

As soon as the rental period has ended, the Renter is deemed, by operation of law and without any notice of default, to be required to return the rented item. From that moment on, Lecomte has the right to reclaim the rented equipment without having to resort to a court of law, regardless of where the equipment is located. All costs such as dismantling, loading, transport, unloading, etc. are entirely at the Renter's expense. For each day of delay in returning the rented equipment, the Renter will owe compensation equal to 30% of the weekly rental price, with Lecomte reserving the right to claim additional compensation.

The Renter's attention is drawn to the fact that they can never become the owner of the rented equipment and that failure to return it at the agreed time indicated above is punishable as breach of trust.

2.8.2. Risks and perils

The Renter bears, throughout the entire rental period, and therefore also during outward and return transport, the burden of risks and perils related to loss, theft and damage to the rented equipment.

Lecomte provides items in good condition. Inspection and counting by the Renter always takes place in Lecomte Stores. The Renter is required to immediately verify, upon receipt of the rented items, the correct number and good condition of the items. Any complaints must be noted on the rental form to be retained by Lecomte, failing which all claims against Lecomte will be null and void. Collection and receipt by the Renter or their representative constitutes tacit and irrevocable acceptance. Any sub-letting is prohibited, unless prior written consent from Lecomte has been obtained.

The Renter is responsible for returning the equipment in the same condition and in the same quantity. Without prejudice to their recourse against third parties, the Renter is responsible for any loss, damage, discrepancy, depreciation, etc. in the broadest sense of the term, without being able to invoke against Lecomte the fault or intent of third parties, chance or force majeure.

The Renter is also responsible, throughout the entire rental period, for any damage or nuisance that the rented item, or its use, even non-negligent, may cause to third parties. They shall indemnify and hold Lecomte harmless with regard to liability for damage occurring to third parties, caused by or in connection with the rented items or their use, or caused as a result of any defect whatsoever and occurring at any time to the items.

2.8.3. Rental fees and payment conditions

All prices stated, as agreed in the rental form, apply to a single use during the agreed period. No discount is granted if the actual period of use is shorter than the flat-rate period. If the actual period of use exceeds the flat-rate period, the rent will be increased pro rata for the additional days. Collection of goods for rentals starting from the weekend is possible from Thursday noon.

Payments are made at Lecomte's business premises (the Stores) or on its Webshop. Full payment will be requested and settled at the time of handover of the goods given for rental.

2.8.4. Deposit

The deposit is intended to guarantee the obligations of the Tenant. It must be paid before collection of the rented equipment. It can never be considered as a down payment on the rental and will only be returned to the Tenant after it has become apparent that the Tenant has fulfilled all his obligations. The deposit never entitles to interest.

2.8.5. Guidelines for use

Recalling what was agreed under point 2.8.2 and without this statement having to be considered as exhaustive, the Tenant's attention is drawn to the obligation that he must observe, taking into account the nature and type of the rented goods, namely to protect the rented goods against excessive strain and damage, and to use the rented goods as a prudent person would.

2.8.6. Miscellaneous provisions

If repair work becomes necessary due to normal wear and tear, the Tenant must immediately notify Lecomte. Lecomte will then carry out the work itself or have it carried out at its own expense by third parties, at no cost to the Tenant. The time required for any necessary maintenance, upkeep and repair work is included in the rental period, unless it concerns repair work that has become necessary due to normal wear and tear. However, the Tenant has no right to compensation on the basis of any interruption in the use of the rented goods and cannot, on this basis, claim a right to terminate the rental agreement. The Tenant may not carry out or have repair work carried out himself, but must communicate all work to be done to Lecomte. Work that becomes necessary due to inappropriate use or lack of care by the Tenant, or due to force majeure or acts of third parties must be paid for by the Tenant, without prejudice to the fact that subletting or lending to third parties is excluded.

Lecomte is not liable for damages occurring to the Tenant and arising from the non-performance, untimely performance or improper performance of any obligation arising for it from these rental conditions, unless the cause of the non-performance, untimely performance or improper performance lies in negligence or serious fault of Lecomte acting itself or with the assistance of its legal representatives.

The Tenant is liable for all damages, of whatever nature, occurring to Lecomte and arising from the non-performance, untimely performance or improper performance of any obligation arising for him from these rental conditions, regardless of the cause of the non-performance, untimely performance or improper performance. Insofar as damages are caused to the rented goods themselves, the value of the rented goods is equivalent to the new replacement value.

Lecomte is not liable for damages occurring to the Tenant due to any defect of any kind occurring at any time to the rented goods.

Deviations from the provisions of these rental conditions are only permitted if this follows expressly from a statement appearing on the rental voucher.

For the adjustment of rented skis, Lecomte will use the most current norm or standard. This norm will always take into account the gender, weight, shoe size and level of the skier.

2.8.7. Jurisdiction

All disputes in connection with the rental fall under the exclusive jurisdiction of the courts and tribunals of Brussels.

2.8.8. Cancellation of rental

Up to one month before the rental period, the rental can be cancelled and will be fully refunded.

Less than one month before the rental period, cancellation is no longer permitted and no refund will be issued.

In the event of a medical certificate for a period of incapacity dating from BEFORE the start of the rental period (up to and including the moment of equipment collection), cancellation will be possible and a full refund will be issued.

NO refund can be issued in the event of a medical certificate for a period of incapacity after the start of the rental period.

2.8.9. Invoicing of charges in the event of loss or irreparable condition

When the Tenant does not return the rented equipment because it has been stolen or lost, or if they return equipment that is damaged to the extent that it can no longer be re-rented, charges will be invoiced to the Tenant. Part of these charges will be settled by withholding the deposit paid by the Tenant. Any remaining balance must be paid additionally by the Tenant.

2.9. Resoling or repair service

Lecomte offers a basic equipment repair service based on its capabilities.

2.9.1. Resoling of climbing shoes

The Buyer can bring their defective climbing shoes to our Stores to have them resoled. Lecomte staff will assess the shoes to provide an initial opinion regarding the resoling.

The Buyer must leave their full contact details (postal address, telephone, e-mail), must pay for the entire service in full and will receive a work order with a reference number. The shoes are sent to our partner for resoling. The resoling process takes between 3 and 4 weeks. Upon return, the Buyer is notified primarily by SMS or e-mail that they can come to collect their shoes. Lecomte keeps the shoes for a maximum of 60 days after the Buyer has been notified (unless otherwise specified at the time of the resoling order).

The Buyer can also request resoling remotely via the Webshop. Once the resoling has been ordered, they will receive an e-mail with instructions on how to send the shoes to Lecomte. The shoes must be sent to: Lecomte Ixelles - Rue de Vergnies 27 - 1050 Brussels. Shipping costs are at the Buyer's expense. At the time of ordering, the Buyer can choose to collect their shoes in store or have them sent to their home. Return shipping costs are also at the Buyer's expense and will be included in the price.

Lecomte accepts no liability in the event of loss of shoes during shipment to its operating locations.

Resoling rates are available in Store and on the Webshop.

2.9.2. Resoling of hiking boots

Just like climbing shoes, the Buyer has the option to have their hiking boots resoled in the Stores. Lecomte currently only resoles the Meindl brand. For other shoe brands, Lecomte can provide the contact details of partners able to assist the Buyer in their request.

The Buyer must leave their complete contact details (postal address, phone number, e-mail), must pay for the entire service and receives a work order with a reference number. The shoes are sent to our partner to be resoled. Resoling takes between 3 and 4 weeks. Upon return, the Buyer is notified primarily by SMS or e-mail that they can come and collect their shoes. Lecomte keeps the shoes for a maximum of 60 days after the Buyer has been notified (unless otherwise stated at the time of the resoling order).

The Buyer can also request a remote resoling service via the Webshop. Once the resoling has been ordered, they will receive an e-mail with instructions on how to send the shoes to us. The shoes must be sent to: Lecomte Ixelles - Rue de Vergnies 27 - 1050 Brussels. Shipping costs are at the Buyer's expense. At the time of ordering, the Buyer can choose to collect their shoes in store or have them sent to their home address. Return shipping costs are also at the Buyer's expense and will be included in the price.

Lecomte accepts no liability in the event of loss of shoes during shipping to its operational sites.

2.9.3. Minor repairs and supplier repairs

Lecomte offers a minor repair service for various equipment (tents, sleeping bags, mattresses, etc.) in Stores. Upon the Buyer's request, a quote will be prepared if Lecomte considers it possible to repair the Buyer's equipment in-house.

Lecomte can also request a quote from certain suppliers to repair equipment that is no longer under warranty. Upon the Buyer's request, Lecomte will contact the supplier to draw up a quote which will then be submitted to the Buyer for approval. If the Buyer accepts, the equipment is sent to the supplier at the Buyer's expense.

The Buyer must leave their complete contact details (postal address, phone number, e-mail), must pay for the entire service and receives a work order with a reference number. Repairs take between 4 and 6 weeks depending on the suppliers.

Upon return or completion of the repair, the Buyer is notified primarily by SMS or e-mail that they can come and collect their repaired equipment. Lecomte keeps the item for a maximum of 60 days after the Buyer has been notified (unless otherwise stated at the time of the repair order).

2.10. Gift vouchers, promotional codes, partner discounts and gift cards

2.10.1. Gift vouchers

Lecomte issues gift vouchers on an occasional basis, either for its partners or for special events. These gift vouchers are considered as full payment methods in the Stores and their value is deducted from the total sale price to the Buyer.

The Buyer must carefully follow the terms of use of the gift voucher as indicated on it. The use of a gift voucher may be subject to a minimum purchase amount and an expiry date.

Gift vouchers (unless otherwise stated) are only valid in the Stores. A gift voucher can never be combined with other offers.

2.10.2. Promotional codes

Lecomte occasionally shares promotional codes on its various distribution channels. These codes are only valid on the Webshop and are, for the most part, subject to terms of use clearly stated at the time of sharing.

2.10.3. Lecomte gift cards

The Buyer has the option to purchase gift vouchers in Stores or on the Webshop.

The Lecomte gift card can be used in one or more transactions in Stores. It is valid for 12 months from its date of issue. The balance and expiry date are indicated on the sleeve the Buyer receives with it and can also be requested in Stores. The general terms of use and the list of Lecomte stores are available on the Webshop.

Gift cards purchased in Stores can be used exclusively in store: present the gift card at the checkout and supplement, if necessary, with a payment method of your choice accepted at your Lecomte store.

Gift cards purchased on the Webshop are valid in Stores and on the Webshop. For in-Store purchases, they will be used upon presentation at the checkout of the code received by email, duly completed where applicable. Once the gift card has been used, even partially, in store, it will be deactivated on the Webshop. When using the gift card on the Webshop: enter the code received in the designated field during checkout. Once the gift card has been used, even partially, on the Webshop, it will be deactivated in Stores.

This gift card cannot be exchanged, refunded, even partially, credited to a card, bank account or another gift card, nor discounted, and cannot give rise to any change being given. It will not be replaced or refunded in the event of loss or theft.

2.11. Customer account

On the Buyer's first visit to a Store, Lecomte offers to create a customer account. The Lecomte customer account entitles the holder to several benefits:

  • Access to the Lecomte loyalty programme
  • Preserving the customer's sales history and ensuring the validity of warranties on purchased products.
  • Notifying them when special orders are available.
  • Providing access to rental, resoling and other services.

To create a customer account in Stores, the Buyer must provide at minimum their first name, last name, email address (mandatory for the loyalty programme) and phone number. They will also be asked to share their postal address and any information useful for the proper implementation of their customer account. By creating their account, the Buyer accepts the general terms and conditions and any subsequent amendments which will be notified to them. If they continue to use their account after such notification, they are presumed to accept the new general terms and conditions.

When placing orders on the Webshop, the Buyer may also choose to create a customer account. They will need to provide the same contact details as in the Stores. Their account will be automatically synchronised with the Stores.

Following the creation of their customer account, the Buyer will receive a one-time welcome email outlining the various benefits of their customer account, the loyalty programme, the sharing of these general terms and conditions of sale, the option to create an account on the Webshop to synchronise their data, and the possibility of subscribing to Lecomte's various commercial emails. The Buyer will also be automatically enrolled to receive loyalty programme updates by email. The Buyer will not receive any other emails from Lecomte unless they choose to do so. They may unsubscribe from mailing lists at any time.

The terms governing the processing of the Buyer's personal data are set out in Lecomte's privacy policy, which is provided to the Buyer and available on the Site and in Store, and which forms an integral part of these terms.

2.12. Invoice requests

The Buyer may, at any time, request an invoice for purchases made at Lecomte. They must have a customer account in order to access the invoicing service.

In Stores, the Buyer may request an invoice directly at the till at the time of purchase. They will need to provide the minimum legally required details to issue an invoice (first and last name, company – if applicable, VAT number – if applicable, postal address). The invoice can be printed directly in Store or sent to them by email upon request. The same applies to receipts.

On the Webshop, if the Buyer needs an invoice, they can enter their VAT number and download it from their customer account or from their order status page.

2.13. Lecomte loyalty programmes

The Lecomte loyalty programme allows the Buyer to accumulate points that can be exchanged for loyalty discounts or rewards in Stores and on the Webshop.

2.13.1. Earning points

You earn loyalty points by purchasing items in our Stores and on our Webshop, based on the principle of: One (1) euro spent = One (1) loyalty point. Services do not generate loyalty point earnings.

2.13.2. General information

Anyone who registers as a customer by sharing their email address on the Webshop or in the Stores has access to Lecomte's basic loyalty programme. Points remain valid as long as there is no inactivity of more than one year across the various sales platforms and/or the various ways of accumulating points.

Once enrolled in the loyalty programme, the Buyer will periodically receive emails with information about their points balance (they may unsubscribe from these notifications at any time). If the Buyer is subscribed to the Lecomte mailing list, a points summary is also available at the bottom of each email sent by Lecomte. Finally, the Buyer can check their points by logging in to the Webshop.

The email address shared in Stores must be the same as that used for the account created on the Webshop in order to benefit from the advantages across all platforms. The support service can be contacted should a problem arise, at the following address: [email protected].

2.13.3. Spending points

The Buyer can spend their loyalty points in exchange for discounts to pay for all or part of their purchases. Payment in Stores is made in the form of a direct discount at the checkout upon the Buyer's request. Payment on the Webshop is made through promotional codes generated by the Buyer and valid for 1 year after their issuance.

Only one loyalty discount can be used per purchase. No cumulation will be possible.

The loyalty discounts are:

  • 200 points = €10 discount
  • 500 points = €25 discount
  • 1000 points = €50 discount
  • 2000 points = €100 discount

Other rewards can be obtained occasionally by spending points.

3.1. Conditions for purchasing in store or placing an order

The Buyer must have legal capacity or, if a minor, hold parental authorisation allowing them to purchase in Stores or place an order on the Webshop.

3.2. Order process

3.2.1. In store

The in-store service is self-service. Sales advisors are available to assist the Buyer with their choices. Payment is made at the Store checkout.

3.2.2. On the webshop

  • Selection of items and adding to cart
  • Validation of cart contents
  • Identification on the Site if the customer is not already identified (optional)
  • Choice of delivery method
  • Choice of payment method and acceptance of the GTC
  • Payment validation

The Buyer can place their order online via the Webshop. The data provided by the Buyer and recorded by Lecomte at the time of the order constitute proof of the transactions between Lecomte and the Buyer. Clicking the validation button after filling in the order form constitutes confirmation of the Buyer's order and an obligation to pay. This validation click serves as proof that commits the customer to an order process and definitively confirms their order. This click will constitute irrevocable acceptance of the General Terms and Conditions of Sale as well as Lecomte's Privacy Policy. The conclusion of the contract will only be effective after Lecomte sends a confirmation email acknowledging receipt of the order. Lecomte reserves the right to refuse a delivery or to fulfil an order in cases where the Buyer has not fully or partially settled a previous order, or where a payment dispute remains outstanding.

3.2.3. Remote

Lecomte offers the possibility of placing orders by telephone, email, or direct messaging. If the products are available on the Webshop, the Buyer will receive an order notification pending payment, which they can settle via the link provided in the order notification.

In cases where items are not available on the Webshop but are available in stores, Lecomte will send a payment link via the Plink platform along with a pro-forma invoice so that the Buyer can settle their order. Once the order has been paid, it will follow the standard delivery procedure.

3.3. Order processing on the webshop or remotely

Any order placed before 12 noon Monday to Friday (excluding public holidays) is prepared and dispatched the same day if all products are shown as in stock and present in the main stock of our Jodoigne warehouse, subject to payment validation. If one or more items need to be transferred, the delivery time will be slightly delayed. The indicative delivery times shown on the Webshop take this possibility into account. Orders placed over the weekend are processed on the next working day. Delivery times are counted from the moment the parcels leave the warehouse. The logistics service operates on weekdays only.

4. Payment

Lecomte offers different types of payment in Stores and on the Webshop. A currency converter is available on the Webshop, but all transactions are carried out in euros. Full payment of the price is due at the time of order by the Buyer, who agrees to pay the stated price for the item(s) ordered, including the price of the items as well as any shipping costs and other order processing fees.

As part of the fight against internet fraud, Lecomte reserves the right to request a photocopy of an identity card and proof of address for any payment.

4.1. Cash payment (in-store only)

Cash payment in euros only is possible in our Stores. The total amount to be paid in cash is rounded to the nearest 0 or 5 cents, as applicable, downwards or upwards.

  • If the total amount to be paid in cash ends in 1 or 2 cents, it is rounded down to x.x0 euro.
  • If the total amount to be paid in cash ends in 3, 4, 6 or 7 cents, it is rounded to x.x5 euro.
  • If the total amount to be paid in cash ends in 8 or 9 cents, it is rounded up to x.(x+1)0 euro.

Maximum cash payments are limited in accordance with Belgian legislation. Lecomte maintains limited cash reserves in store, which means that certain banknotes may be refused at the start of the day or if the availability of cash is insufficient to provide change.

4.2. Payment by bank card (store, webshop and remote)

Only payment by one of the following bank cards will be accepted: Bancontact, Visa, Mastercard, American Express. The card is debited at the time of order or sale confirmation. The Buyer guarantees to Lecomte that they have any necessary authorisations to use the card payment method when placing an order. Lecomte implements all necessary means to ensure the security and confidentiality of data transmitted on the Webshop and in Stores (including online payments, under the conditions indicated in the Privacy Policy).

The Buyer also has the option to use contactless payment and the Payconiq service in Stores.

4.3. Payment by PayPal (webshop and remote)

PayPal is a payment service provider specialising in the issuance of electronic money between the Buyer and a third party. PayPal ensures the confidentiality of the Buyer's banking information. As such, the Buyer's financial information is never shared with Lecomte. PayPal encrypts and protects the card number. The Buyer pays online by simply entering their email address and password. In the event of a problem with a PayPal payment, PayPal's general terms and conditions will apply. If Lecomte is not credited in whole or in part, the Buyer may only seek recourse against PayPal, to the exclusion of any liability on the part of Lecomte.

4.4. Payment by eco-vouchers, meal vouchers, gift vouchers, gift pass (in-store only)

Lecomte accepts Eco-Vouchers for all purchases except fuels (Gas, Oil, etc.) and non-rechargeable batteries.

Meal vouchers are accepted on the entire food range.

Gift vouchers and gift passes are accepted on the entire Lecomte assortment.

4.5. Payment by Lecomte gift voucher (store and webshop)

The Buyer can use a Lecomte gift voucher purchased on the Webshop or in the Stores to make purchases in Stores.

Gift vouchers issued from the Webshop are also valid on it, unless they have been partially used in Stores.

Gift vouchers issued from the Stores are only valid in Stores.

4.6. Payment by loyalty discount (stores and webshop)

In accordance with the Lecomte loyalty programme, the Buyer can spend their loyalty points in exchange for discounts to pay for all or part of their orders.

Payment in Stores is made in the form of a direct discount at the checkout upon request of the Buyer.

Payment on the Webshop is made via promotional codes generated by the Buyer and valid for 1 year after their issuance.

Only one loyalty discount can be used per purchase. No cumulation will be possible.

5. Delivery

Products are delivered to the delivery address specified during the order process or during contact via eligible channels for remote ordering. In the event of an error in the address details, Lecomte cannot be held responsible for any failure to deliver. In such a case, the costs incurred for a new delivery will be borne by the Buyer and charged at their actual cost.

Lecomte undertakes to make its best efforts to ensure that the delivery of ordered items is carried out as quickly as possible depending on the chosen delivery method and the availability of the items. The delivery times indicated on the Webshop are standard average times and correspond to the total processing and shipping time. In the event of an order for several products at the same time where the shipping times differ, the actual shipping time may be the longest one, as the entire order is prepared when all the products that make it up are in stock at Lecomte.

Delivery is deemed to have taken place upon handover of the product to the Buyer or their authorised representative.

5.1. Checking the condition of the parcel upon delivery

Lecomte recommends that the Buyer checks the contents, conformity and condition of the parcel(s) upon delivery and in the presence of the carrier. In the event that the Buyer has any doubt of any nature whatsoever regarding the condition or contents of their parcel, the Buyer must:

  • check the condition of the goods received and make precise, dated and signed handwritten reservations, having the delivery person sign alongside;
  • and pursue any claim with the carrier by registered letter with acknowledgement of receipt within ten (10) working days of receipt, and send a copy to Lecomte. After this period, the product will be deemed received in conformity by the Buyer, who will no longer be able to claim a delivery error, defect or apparent fault. 

The verification of the delivered parcel is deemed completed and can no longer be disputed, once the Buyer or their representative has received the parcel. Lecomte's liability cannot under any circumstances be called into question.

5.2. Delivery delay

If a delivery delay occurs, or parcels are lost by the carriers, the Buyer must notify Lecomte by email or phone within ten (10) days following receipt by email of the order confirmation. Lecomte assists the Buyer with the procedures with the carriers. Lecomte is not responsible for any delay in the processing of the complaint by the carrier.

5.3. Delivery in case of absence

If the recipient is absent at the time of delivery, the carrier will leave a delivery notice at the delivery address indicated by the Buyer. The order must be collected at the address and according to the conditions indicated by the carrier. If the order is not collected within the time limits set by the carrier, the order will be returned to Lecomte, who reserves the right to refund the price, with shipping and return costs remaining the responsibility of the Buyer.

5.4. Delivery to collection points

Lecomte offers the possibility of delivery to a collection point in Belgium and in certain countries via bPost and DPD. The Buyer is notified once the parcel is available for collection. The parcel remains available for 14 days. If the order is not collected within the time limits set by the carrier, the order will be returned to Lecomte, who reserves the right to refund the price, with shipping and return costs remaining the responsibility of the Buyer.

5.5 In-store collection

Products ordered on the Lecomte Webshop can be collected in-store (Ixelles or Waterloo), at Maniak and at certain Lecomte partners. This collection method can be selected via the cart page in the order process. An email is sent to the Buyer when the parcel is ready to be collected from the warehouse. This timeframe may vary depending on product availability. To collect the product, the Buyer simply needs to bring their order number and a form of identification. The parcel remains available for 14 days at your collection store. In the event that the Buyer is unable to collect their order in person, the person collecting the parcel on their behalf must bring the Buyer's identification (original or copy).

6. Right of withdrawal, refund or exchange

6.1. Conditions for exercising the right of withdrawal

The Right of Withdrawal is considered to have been correctly exercised when the following conditions are fully met:

- Timeframe

The Buyer has a period of thirty (30) days from their in-store purchase or delivery of their online order, to notify their wish to withdraw without having to justify the reason, nor to pay any penalties, with the exception of return costs for Webshop orders of discounted products and export orders.

The return is at the buyer's expense. The Buyer has the option to return items purchased on the Webshop directly to the Stores free of charge.

In the case of postal returns, return costs are free for Belgium. For other countries, the applicable shipping costs will be charged.

For items purchased on the Webshop, after contacting customer service, the Buyer has a period of thirty (30) clear days to return the merchandise in its original condition. 

The period runs from the date of receipt of the product. It is understood in calendar days.

- Condition of the product

The product must be returned, properly protected in the original brand packaging, undamaged, accompanied by all possible accessories, instructions for use and documentation provided at the time of purchase.

Products may not have been used to an extent that exceeds what is necessary to assess their nature, characteristics and proper functioning. If they have been tested, they must be cleaned of all traces of use. Otherwise, Lecomte will be obliged to charge the Buyer a flat fee of 20 euros.

Lecomte reserves the right to apply a depreciation to any returned product showing signs of use exceeding what is necessary for this verification. The consumer will bear full responsibility for any loss of value resulting from such handling.

No return will be accepted if the returned products have been visibly used or damaged by the Buyer and that such use or damage renders the products unfit for resale.

6.2 Exceptions to the right of withdrawal

In accordance with article VI.53 of the Code of Economic Law (transposition of Directive 2011/83/EU on consumer rights), the right of withdrawal does not apply to contracts relating to the following products:

- Sealed products – hygiene and health protection

The right of withdrawal cannot be exercised for sealed goods that cannot be returned for reasons of hygiene or health protection and which have been unsealed after delivery.

This includes in particular:

  • hygiene products;
  • cosmetics (soaps, creams, sprays, etc.);
  • containers intended for food use (water bottles, hydration bladders, etc.);
  • cleaning products;
  • food products.

- Products likely to deteriorate or expire quickly

The right of withdrawal does not apply to goods that are likely to deteriorate or expire quickly.

- Products made to the consumer's specifications

The right of withdrawal is excluded for goods that are:

  • made to the consumer's specifications; or
  • clearly personalised.

Example: ropes sold by the metre cut to the requested length.

- Personal Protective Equipment (PPE)

Due to the safety, traceability and regulatory compliance requirements applicable to PPE, the following conditions apply:

a) Textile PPE and critical equipment

The right of withdrawal is excluded for textile PPE and similar items when they have been unsealed after delivery or handled in any way other than to check their nature, characteristics and proper functioning.

This includes in particular:

  • ropes;
  • lanyards;
  • slings;
  • harnesses.

These products cannot be placed back on the market as new products once their integrity or usage history can no longer be guaranteed.

b) Mechanical PPE (conditional return)

Non-textile PPE (including carabiners, belay devices, pulleys, ascenders, helmets, etc.) may only be returned if all of the following cumulative conditions are strictly met:

  • completely unused;
  • never loaded;
  • no signs of wear, impact or handling whatsoever.

Otherwise, Lecomte reserves the right to refuse the return and refund.

- Unsealed goods containing digital content or software

The right of withdrawal does not apply to sealed goods that have been unsealed after delivery and containing software or digital content not supplied on a tangible medium, or requiring activation.

Examples: GPS devices, smartwatches.

- Other exclusion cases

The right of withdrawal is also excluded for:

  • products that have been used beyond what is necessary to verify their nature, characteristics and proper functioning;
  • climbing shoes that have been worn;
  • any product rendered unfit for resale for reasons attributable to the consumer.

6.2. Return procedure

The Buyer can directly exchange their product in one of the Lecomte Stores completely free of charge, regardless of where the purchase was made.

The Buyer can also contact the Lecomte customer service by e-mail at [email protected], by phone or direct messaging. Lecomte will indicate the steps to follow to make the return. The return of a Webshop order can also be done via the return portal provided for this purpose: https://lecomte.shipping-portal.com/

Returns to Stores are accepted (Ixelles, Waterloo) with the purchase receipt, or without a receipt if the purchase was made from a customer account, and if the product is in the same original condition.

The return is made under the sole responsibility of the Buyer and any risk related to the return of the goods (deterioration, theft, breakage) remains the responsibility of the Buyer.

Returns of goods with postage due will not be accepted.

Lecomte cannot be held responsible for problems encountered following a return via letterbox (improper use of the service, theft of parcels from letterboxes, breakage, …)

Upon receipt of your return parcel, Lecomte verifies the compliance of the return. No return will be accepted if the returned products have been visibly used or damaged by the Buyer and that this use or damage renders the products unfit for sale. If the return cannot be accepted, Lecomte will contact the Buyer regarding the arrangements for sending the products back at the Buyer's expense.

6.3. Return processing

Subject to acceptance, Lecomte will offer:

- Store credit

When returning in store, the Buyer may choose to add the value of their return as store credit to their customer account. This credit remains available on the Buyer's account for a period of one year.

- Refund or exchange

Purchases can be refunded either in store (in cash) or, in the case of a Webshop purchase, directly to the original payment method if possible.

In the case of an online refund, Lecomte will refund the Buyer as soon as possible and no later than fourteen (14) days following receipt of the returned products in our warehouse, less any applicable return shipping costs.

Returns are free of charge for Belgium only. For returns from France, Luxembourg and the Netherlands, return shipping costs can be paid directly via our returns portal.

For all other countries (including France, Luxembourg and the Netherlands, if the Buyer chooses not to use our returns portal), the Buyer will need to send the parcel at their own expense using a delivery service of their choice, to the following address:

The Buyer must include the order form or invoice in the parcel. Parcels remain the responsibility of the Buyer until delivery of the parcel to our warehouse.

The refund will be made to the billing address registered at the time of the order, via the payment method used for settlement, where possible. Shipping costs paid for the initial dispatch of the goods, when these have been correctly delivered and received by the Buyer, are never refunded, except in the event of a defect found on the delivered products.

Lecomte offers an exchange guarantee as a goodwill gesture. The Buyer may exchange an unused item within 30 days upon presentation of their receipt.

No item will be accepted for return if it is not returned in new condition and in its original packaging, or if it has been used. No signs of wear will be accepted. Lecomte reserves the right not to offer these goodwill gestures if the conditions are not met.

In order to exercise a right of withdrawal, the Buyer is required to also return to Lecomte any items offered as part of a promotional offer at the time of purchase of the returned goods.

7. After-sales Service / Legal Guarantee


7.1. Scope of application


These conditions apply to all customers who have purchased a product from Lecomte, whether they are consumers or professionals.

The rights granted to consumers by the Code of Economic Law are mandatory and cannot be reduced.

The provisions specific to professionals are governed contractually below.


7.2. Warranty period


All products sold by Lecomte come with a two (2) year warranty from the date of delivery.

  • For consumers, this warranty is statutory in nature, in accordance with articles VI.47 and following of the Belgian Code of Economic Law and European directive 2019/771.
  • For professionals, this warranty is a contractual warranty, covering exclusively manufacturing defects occurring under normal conditions of use.


7.3. Lack of conformity – Consumers


A lack of conformity is deemed to exist when:

  •  The product does not match its description or does not function as expected;
  • It does not possess the promised qualities;
  • It is unfit for its normal intended use.


During the twelve (12) months following delivery, any defect is presumed to have existed at the time of delivery, unless proven otherwise. Beyond this period, the burden of proof lies with the consumer.

The consumer has two (2) months after discovering the defect to notify Lecomte.


7.4. Contractual warranty – Professionals


The contractual warranty applicable to professionals covers manufacturing defects for two (2) years, provided the product has been used in accordance with the manufacturer's recommendations.


The following are excluded from the warranty:

  •  Defects resulting from abnormal, intensive or improper use;
  •  Damage caused by external factors (accident, impact, moisture, etc.);
  •  Normal wear or defects resulting from lack of maintenance;
  •  Repairs or modifications carried out without prior agreement.


Lecomte's liability towards professionals is limited to the purchase price of the product concerned, to the exclusion of any indirect damage or loss of business.


7.5. Implementation procedures


a) In-store drop-off

Products may be dropped off at our stores in Ixelles, Waterloo or Jodoigne, under the following conditions:

  • Product must be clean, dry, and free of personal items;
  • Presentation of proof of purchase (receipt or invoice).


In the case of a dirty product, Lecomte may temporarily refuse processing or offer a cleaning service charged at €25 incl. VAT, particularly for footwear.


b) Online after-sales service

The Buyer contacts [email protected] with:

  • A description of the defect,
  • Three photos of the product,
  • The order number.

A return form will be provided. The product must be returned clean, accompanied by the return form and proof of purchase. 
Return shipping costs are at the Buyer's expense, unless the defect is covered by the warranty, in which case they will be reimbursed.


7.6. Processing and assessment


Upon receipt, an initial inspection is carried out by Lecomte. If necessary, the product is

forwarded to the manufacturer for assessment.

The final decision on warranty coverage rests with Lecomte, based on the technical diagnosis

and the conditions of use.

Submitting a product does not automatically constitute recognition of warranty coverage.

In the event of refusal, a repair estimate may be provided, subject to feasibility.


7.7. Manufacturer's commercial warranty


Some products benefit from an additional commercial warranty provided by the manufacturer. Lecomte can, at the customer's request, manage the case subject to:

  • A processing fee of €14.95;
  • Return shipping costs, to be borne by the customer.


This service is optional. The customer may also contact the manufacturer directly.


7.8. Liability


Lecomte stores products under normal security conditions. It cannot be held liable for losses, thefts or damage resulting from cases of force

majeure or third-party interventions (carriers, manufacturers, etc.).


7.9. Unclaimed Items


Any product not collected within three (3) months after notification (by email or phone) may be considered abandoned, in accordance with article 2279 of the Civil Code.

Lecomte reserves the right to destroy it or dispose of it freely.


7.10. Potential Fees


Fees may be charged in the following cases:

  • Refusal of the repair quote,
  • Return of the product without repair,
  • Out-of-warranty processing.


7.11. Dispute Resolution


In the event of a dispute, the customer may have recourse to:

In the absence of an amicable resolution, the courts of Nivelles shall have sole jurisdiction, unless mandatory legal provisions dictate otherwise.


8. Customer reviews and comments

The following rules specify the conditions under which the Buyer may submit or use a customer review on the Webshop. These rules supplement the Webshop's terms of use as well as the privacy policy and apply to all users.

By viewing and submitting content on the Webshop, the user agrees to comply with all terms and conditions of these rules.

8.1. How to write a review on our webshop

Lecomte takes pride in ensuring that its customers obtain all the information they need to make informed decisions about its products. Lecomte encourages all Buyers to share their product experience, while also complying with these simple guidelines:

Every review must:

  • reflect your honest opinion
  • whether positive or negative;
  • be accurate - state the facts;
  • be consistent - focus on specific characteristics of the product and your experience with the product;
  • be brief.

Your review must not:

  • be obscene, unpleasant, offensive or malicious;
  • be defamatory or constitute an act of harassment towards another person;
  • involve identity theft or misrepresentation of your identity;
  • contain the name, contact details of another person or any other personal data relating to another person;
  • contain advertising or promotional material or links to another website;
  • contain material created by another person or that violates the rights of another person;
  • contain details regarding the price or availability of the product;
  • contain comments regarding another customer's review.

These guidelines apply to each customer review and must be respected in both spirit and letter. Lecomte will determine at its sole discretion whether a customer review violates these guidelines.

8.2. Use of customer reviews and comments

You will retain all copyright relating to any customer review you submit on our Webshop.

By posting a customer review:

  • you grant us the right to freely use, modify, alter, reproduce, publish and distribute the material contained in your customer review. This permission is free of charge, permanent and may be assigned to a third party at our sole discretion;
  • you guarantee to us that your review is entirely original and that it has not been extracted wholly or substantially from another review and does not violate any of our guidelines (set out above);
  • you waive all moral or similar rights you may have in your customer review, to the extent permitted by law.

The rights you grant us by submitting a customer review on our Webshop include (without limitation) that we are free to publish all or part of that review, even if you change your mind and ask us to remove it and even if it does not violate our guidelines. Furthermore, we may use that customer review in connection with the promotion of products and services on our Webshop.

8.3. Violations of the conditions on customer reviews

Lecomte reserves the right to refuse, remove or modify at its sole discretion any customer review if we consider that it violates these rules, and we expressly disclaim any liability for any loss or damage arising from the use of customer reviews by any person in conditions that violate these rules.

If we consider that a violation of these rules has occurred, we may, at our sole discretion, take such measures as we deem necessary. Failure to comply with these rules constitutes a material breach of the terms of use under which you are permitted to use our Webshop and may lead us to take one or all of the following measures:

  • immediate, temporary or permanent withdrawal of your right to use our website;
  • cancellation of any loyalty points earned and banning from our loyalty programme;
  • immediate, temporary or permanent removal of any customer review already published on our website;
  • issuance of a warning to you;
  • legal proceedings against you to obtain reimbursement of all costs (including, without limitation, our reasonable administrative and legal costs) incurred as a result of the breach;
  • further legal proceedings against you;
  • disclosure of such information to law enforcement authorities if we consider such action to be reasonably necessary or required by law.

Lecomte disclaims all liability for any measures we may take following violations of these rules. The measures described above are not exhaustive and we may take any other measures we deem reasonably necessary.

8.4. Liability

Any customer review or other material published on our website is provided without any condition or warranty as to its accuracy. To the extent permitted by law, Lecomte and the third parties with whom we collaborate expressly exclude:

11. Intellectual property

All data, texts, photos, comments, works, illustrations and images reproduced on the website www.lecomte-alpirando.be are its property. Consequently, it is strictly forbidden to reproduce, download, copy, or exploit them, even partially, for commercial purposes anywhere in the world, without prior agreement from Lecomte.

12. Liability

The products offered in Stores and on the Webshop comply with current Belgian legislation and standards.

Lecomte cannot be held liable for the non-performance or improper performance of the contract concluded between the parties in cases of force majeure, occurrence of an event attributable to the customer, or any inconvenience or foreseeable or insurmountable damage inherent to the use of the internet.

Lecomte cannot be held liable for any indirect damages that may arise from the purchase of products.

Photographs, graphics and descriptions accompanying the products have no contractual value and therefore cannot engage the liability of Lecomte.

As the Webshop is hosted by an external provider, Lecomte cannot be held liable for any service interruption of the site, occurrence of bugs, inaccuracies or omissions regarding information available on the site, or for any damages resulting from fraudulent intrusion by a third party that has altered the information present on the site.

For all stages of accessing the Site, browsing, filling in forms, placing orders, delivery of items or any other service, Lecomte has only a best-efforts obligation. Consequently, Lecomte's liability cannot be engaged for any inconveniences or damages inherent to the use of the internet network (loss of data, files, etc.) that are entirely beyond the normal diligence and precautions taken by Lecomte.

Lecomte disclaims all responsibility for the content of the site(s) to which hyperlinks from its own site may lead, as it cannot control their content.

13. Applicable Law

These General Terms and Conditions of Sale are governed by Belgian law. In the event of a dispute, the parties will seek an amicable agreement as a priority before any legal action.

In the absence of an amicable settlement, any dispute between the parties shall be settled exclusively by the courts and tribunals of the district of Brussels (Belgium).
